State AGs Seek FTC Action on Food Delivery Fees

In this FTCWatch article, Zach Lerner discusses the bipartisan push by more than a dozen state attorneys general urging the FTC to extend its Rule on Unfair and Deceptive Fees to online food delivery platforms such as DoorDash and Grubhub.

Zach noted that the AGs’ letter, combined with the FTC’s ongoing rulemaking process, signals growing momentum around pricing transparency in the food delivery space. He walked through the likely path forward for the agency, explaining that analyzing the more than 250 public comments received could take months, with additional rounds of public comment potentially to follow before any final rule takes shape.

The process is “an indication that the FTC is considering this issue closely,” Zach said.
