Bio

Daniel de Zayas advises internet, technology, and social media companies on their rights and responsibilities in responding to requests for user information, corporate records, and testimony. He routinely advises clients on non-party discovery requests from law enforcement, civil litigants, and criminal defendants, including issues concerning the Electronic Communications Privacy Act (ECPA) and state equivalents, subpoena power and extraterritorial authority, personal jurisdiction, shield laws, preservation, user notice, and emergency disclosures. He regularly works with in-house legal, trust & safety, and compliance teams to develop internal policies, processes, and playbooks for handling legal demands for user information.

 

Daniel is a pragmatic advocate who combines a deep understanding of his clients’ products, services, and legal obligations with a practical approach to dispute resolution, often engaging with government agencies and civil litigants to resolve non-party discovery disputes. 

 

Additionally, Daniel litigates issues related to legal process response, including challenges to subpoenas seeking communications content protected by the Stored Communications Act (SCA), unduly burdensome records and testimony, and premature discovery. He also represents clients in disputes involving law enforcement requests.

 

Daniel received his J.D., magna cum laude, from American University Washington College of Law, where he served as an editor on Law Review. During law school, he worked as a research assistant for Professor Jennifer Daskal, researching data extraterritoriality and content moderation.
