Six Weeks In, U.S. Government Shutdown Delays Inject uncertainty Into FTC Probes

In this MLex article, Stacey Brandenburg explains what the U.S. government shutdown meant for FTC investigations, and why the shutdown didn’t necessarily provide an advantage to either side of a probe. As deadlines became murky and federal staff members were furloughed, most cases were likely paused anyway. “…As a practical matter, a company will not be able to submit responses to a CID or investigatory demands, negotiate the scope of requests or a potential settlement with the FTC,” Stacey said. “In some instances, this may mean that deadlines are suspended explicitly or implicitly.”
