As companies are increasingly subjected to potential investigations, the importance of properly identifying what data they have and how its stored is constantly being highlighted.
Marc notes that many companies with significant quantities of user data “view themselves as a guardian of some of that data, and they don’t want to disclose that data improperly to third parties.” In civil litigation, companies are seeing “enforcement authorities are interested not just in their practices, but the user data that they have maintained,” so companies are more focused on “data retention, data encryption, end-to-end encryption and other ways to make sure that the data is protected when it’s in their possession.”
