Enforcement of Sections of Negative Option Rule Delayed Until July 14

In this FTCWatch article, Zach Lerner explains the Negative Option Rule following the announcement that its initial compliance date of May 14 has been deferred two months. At its core, the rule is about giving consumers the opportunity and ability to cancel a subscription, Zach says. “The most notorious part of the Negative Option Rule is that it will require separate consent to the ‘negative option’ feature. That consent [for a negative option plan] must be distinct from the consent — must be distinct — from the link to the terms of sale and the instruction to the company to initiate the subscription.”
