Congress considers ‘click-to-cancel’ bills after FTC rule is blocked

In this FTCWatch article, Zach Lerner helps explain the landscape of “click-to-cancel” bills as unwanted subscription issues continue to be in the spotlight of senators and legislators across the country. While the Negative Option Rule was halted by a federal appeals court on July 8, 2025, FTC Commissioner Rebecca Kelly Slaughter recently shared her desire to restore the click-to-cancel rule, which would prohibit unfairly trapping consumers in recurring subscriptions. Meanwhile, Arizona Senator Rubén Gallego has put forward a bill that would simply codify the old Negative Option Rule.

Zach explained that this back and forth of various legislative efforts at the state as well as federal levels isn’t going anywhere, anytime soon. “This is a bipartisan issue that legislatures, regulators, and others understand consumers care about.”
