Bio

Laura-Kate Bernstein is a litigator and former federal prosecutor who brings more than a decade of trial, investigative, and courtroom experience to ZwillGen’s Litigation and Law Enforcement teams. She represents technology companies and online platforms in complex disputes involving privacy, cybersecurity, consumer protection, and law enforcement access to data, guiding clients through every stage of litigation. Laura-Kate maintains a broad practice focused on resolving class actions, mass arbitrations, and other disputes efficiently and thoughtfully, with an emphasis on minimizing the business disruption and pressure that often accompany litigation. She also counsels technology companies and online platforms on compliance with the TAKE IT DOWN Act and other emerging online safety and content moderation requirements.

Laura-Kate works closely with companies responding to U.S. and international law enforcement requests and third-party subpoenas. Drawing on her extensive DOJ experience, she counsels clients on the Stored Communications Act, the Pen Register Statute, cross-border data requests, and law enforcement response strategy. She has significant experience litigating disputes over compelled disclosures and government process and helping clients navigate interactions with federal and state investigators.

Prior to joining ZwillGen, Laura-Kate served in senior roles in both the Civil Rights Division and the Computer Crime and Intellectual Property Section (CCIPS) of the U.S. Department of Justice, where she led federal jury trials, prosecuted cyber-enabled and fraud-related offenses, litigated complex constitutional and statutory issues nationwide, and advised on electronic evidence gathering, government surveillance, cross-border data sharing, and cybercrime policy. She also trained federal prosecutors and investigators across the country on the Stored Communications Act, the Pen Register Statute, and the Computer Fraud and Abuse Act.

Outside the office Laura-Kate serves as the Chief Procurement Officer for a family of five (her own) and spends her precious free time playing tennis, avoiding emails from the PTA, and obsessing over every dog in the neighborhood.
