Bio

Laura-Kate Bernstein is a seasoned litigator and former federal prosecutor who brings more than a decade of trial and investigative experience to ZwillGen. As part of the firm’s Litigation and Law Enforcement teams, Laura-Kate advises clients on a broad range of issues related to privacy, cybersecurity, and government requests for information.

Prior to joining ZwillGen, Laura-Kate was a prosecutor with the Civil Rights Division’s Criminal Section where she served as lead counsel on numerous federal jury trials, securing convictions across the board. In the course of her trial practice, Laura-Kate litigated complex issues of constitutional and statutory law in federal district courts across the country. She is also a deeply experienced investigator, having served as the Criminal Section’s in-house expert on investigations involving electronic evidence gathering under the Stored Communications Act and the federal Pen Register Statute.

Before joining the Civil Rights Division, Laura-Kate served as Senior Counsel in the Computer Crime and Intellectual Property Section of DOJ’s Criminal Division. There, she litigated federal computer fraud, wire fraud, access device fraud, and cyberstalking violations and trained federal investigators and prosecutors across the country on the Stored Communications Act, the Pen Register Statute, and the Computer Fraud and Abuse Act. In addition, she litigated challenges to lawful government surveillance and secrecy practices. On the policy side, Laura-Kate advised Division leadership and other stakeholders on legislative and policy proposals touching on issues of electronic evidence gathering, cross-border data sharing, and cyber-enabled crime.

Laura-Kate holds an active TS/SCI security clearance. After earning her J.D. from Harvard Law School, she clerked for the Honorable Scott W. Stucky of the United States Court of Appeals for the Armed Forces.
