White House AI Policy Framework: Seven Legislative Priorities

The White House released its National Policy Framework for Artificial Intelligence, outlining seven core areas for Congressional action regarding AI legislation. The Framework offers recommendations spanning child protection, community impacts, intellectual property, free speech, innovation policy, workforce development, and federal preemption. 

As a document, the Framework is brief, high-level, and does not itself create legal obligations. Its practical function is to translate the Administration’s current AI policy posture into a congressional “ask.” That is especially clear from the repeated phrasing: “Congress should,” “Congress should not,” and especially “Congress should preempt” burdensome state AI laws. The document is effectively saying two things at once: the Administration has a policy position across seven AI topics; and achieving this via durable change now requires legislation.

Another likely goal is to consolidate various previous executive signals into a single federal legislative program. The Framework ties together child protection, infrastructure and energy, copyright, anti-censorship, innovation, workforce, and preemption under one “national policy framework.” That gives Congress, agencies, industry, and states a single statement of priorities. Those include:

Child Protection and Platform Responsibilities

The Framework’s first pillar centers on protecting children while empowering parents and establishing multiple layers of platform obligations. The Framework proposes that Congress should establish “commercially reasonable, privacy protective, age-assurance requirements” for platforms likely to be accessed by minors and should require these platforms to implement features reducing risks of sexual exploitation and self-harm.

The recommendations include robust parental control tools for managing children’s privacy settings, screen time, and content exposure. The Framework simultaneously advises that Congress should affirm that child privacy protections apply to AI systems as well, and should “avoid setting ambiguous standards about permissible content, or open-ended liability, that could give rise to excessive litigation,” but without preempting state action. 

Protecting Communities via Energy Infrastructure and Safeguarding

The Framework proposes that Congress should ensure that residential ratepayers do not experience increased electricity costs as a result of new AI data center construction and operations. The Framework also recommends that Congress streamline federal permitting for AI infrastructure construction and operation so developers can develop on-site power generation to accelerate buildout and enhance grid reliability. 

While seeking to ensure technical sufficiency to understand frontier AI models as they may impact national security, it also calls for law enforcement support against AI-enabled impersonation scams and fraud targeting seniors, and recommends grants, tax incentives, and technical assistance to help small businesses deploy AI tools.

Intellectual Property Through Judicial Resolution

The Framework takes a distinctive approach to copyright questions. The Administration takes the position that training AI models on copyrighted material does not violate copyright laws, but “acknowledges arguments to the contrary exist and therefore supports allowing the Courts to resolve this issue,” and asks Congress to respect that process as well. 

However, it does suggest that Congress should consider enabling licensing frameworks or collective rights systems for rights holders to collectively negotiate compensation from AI providers, without incurring antitrust liability. 

The Framework also proposes establishing federal protections for individuals from unauthorized distribution or commercial use of AI-generated digital replicas of their voice, likeness, or other identifiable attributes, with clear exceptions for parody, satire, news reporting, and other First Amendment-protected works. It leaves open the possibility that Congress may need to take further action to fill gaps even as courts act and technology changes.

Free Speech and Government Restraint

In what is potentially one of the more targeted sections, the Framework echoes language from other recent federal guidance that assumes political bias by technology providers. It asks Congress to take action that would prevent government agencies from issuing guidance that might seem to “ban, compel, or alter content based on partisan or ideological agendas.” Additionally, it recommends that Congress provide a means for people to seek redress from the Federal Government if they feel such agency guidance caused AI platforms to censor their own expression or control/limit platform-provided information (user feeds).

Individuals can already sue the federal government in some settings, especially for injunctive or declaratory relief, and in narrower statutory contexts like FOIA, the Privacy Act, and other specific contexts. But for the situation here, alleging that federal pressure on AI providers suppressed lawful speech or shaped content, current remedies may have seemed patchy, difficult, or insufficient. The Framework’s “effective means of redress” language therefore is likely advocating for a new express statutory cause of action, or at least a bespoke complaint-and-review mechanism aimed specifically at federal censorship-by-regulation in AI systems.

Innovation Through Existing Structures

The Framework expressly frames the objective as “American AI dominance,” including broad access to testing environments needed to build world-class AI systems, a framing that is central to the document. It calls for “regulatory sandboxes for AI applications” to accelerate development and deployment, and proposes that Congress should not create any new federal rulemaking body to regulate AI, but should support development and deployment through existing regulatory bodies with subject matter expertise and through industry-led standards.

The Framework recommends making federal datasets accessible to industry and academia in AI-ready formats for model training purposes.

Workforce Development and Education

The framework emphasizes that American workers must benefit from AI-driven growth through youth development, skills training, job creation, and expanded opportunities across sectors. It proposes that Congress should use non-regulatory methods to ensure existing education programs and workforce training programs affirmatively incorporate AI training, and also advocates for apprenticeships and enhanced capabilities at land-grant institutions for technical assistance and demonstration projects.

Federal Framework and State Preemption

Reiterating a focus from the most recent Executive Order on AI, the framework proposes that Congress should preempt state AI laws that impose undue burdens, in part by creating a “minimally burdensome national standard.” It preserves state authorities only in specified areas, including: traditional enforcement for laws of general applicability including child protection and fraud prevention; state zoning laws affecting AI infrastructure placement; and the allowance for states to govern their own use of AI via procurement or when part of their delivery of services like law enforcement and public education.

The framework specifies that preemption should expressly target regulation around AI development, as it is “an inherently interstate phenomenon with key foreign policy and national security implications.” It proposes that states should not “unduly burden” Americans’ use of AI for activities that would be lawful if performed without AI. This is apparently meant to include commercial uses and applications as well as other individual, research, or related areas. Finally, preemption in this context would require that states not be able to penalize AI developers for third parties’ unlawful conduct involving their models.

Conclusion

The framework’s likely value is less in immediate legal effect and more in framing and agenda signaling. It can be used as White House-aligned talking points for agencies, committees, trade groups, and private actors; it can be cited to organize draft bills; and it will likely be referenced as the Administration’s official answer to the increasingly common question whether AI policy should remain sectoral and state-led or become federally standardized.

Congress has constitutional authority for the actions in question, including in some circumstances to preempt state law, especially where it legislates under the Commerce Clause and does so clearly. However, the Framework is asking for unusually assertive preemption. It is not just proposing a floor of standardized protections around a narrow product-safety issue or a specific reporting format. It says states should not be permitted to regulate AI development; should not unduly burden lawful uses of AI; and should not penalize developers for third-party unlawful conduct involving their models. That is a large transfer of policy authority upward. That means members of Congress are being asked to vote for something that many state attorneys general, governors, and legislatures are likely to characterize as displacement of their own authority to respond to consumer protection, civil rights, education, employment, election integrity, and public-safety concerns.

The broad preemption plank is possibly the least legislatively achievable part of the package. Limited or issue-specific preemption is plausible but sweeping displacement of state AI authority is materially less so, if only because members of Congress often remain politically loyal to state interests even when acting at the federal level.
